Collaborative Planning

The Farina Law Firm believes strongly in the collaborative model of estate planning.  Our planning process is designed to include the input of other attorneys who have particular experience with certain aspects of the estate plan; a client’s financial and tax professionals; funeral professionals; and anyone else who may bring meaningful insight into the planning process and therefore deliver a thorough, coordinated result.  In addition, when it benefits the clients to conduct a family meeting or briefing, Farina Law Firm will foster this family communication to ease apprehension and confusion.

Asset Protection

Mason D. Salisbury, Esq. / Pelzer & Salisbury, LLC

Mason is a twenty-five year member of the South Carolina Bar.  After a gap in his education, Mason went back to college in his late twenties, earning his undergraduate degree in jurisprudence from the University of Baltimore and graduating from the University of Baltimore School of Law in 1987, with honors and as a member of the Law Review.  He then moved to Charleston with his wife who had worked while Mason attended law school . He was happy to return the favor while she went on to medical school.

Mason’s first 15 years of practice were strictly as a creditors’ attorney focusing on commercial litigation and judgment collection. He counts himself fortunate as a young attorney to have gained impressive asset protection experience in complicated creditor/debtor litigation representing the Federal Deposit Insurance Corporation and the Resolution Trust Corporation as South Carolina outside counsel in bank failure related litigation.  During his work as a creditors’ attorney Mason developed a healthy respect for the asset protection potential of properly organized limited liability companies and has since developed his own LLC system and LLC operating agreements.  Two of Mason’s LLC operating agreements appear in the current Limited Liability Company Handbook, 2013 – 2014 Edition, published by Thomson Reuters Westlaw.

Over the last 10 years Mason transitioned his practice away from going to court and creditor representation to focusing exclusively on estate planning, elder law, inheritance protection, and asset protection. On his new focus Mason notes,  “Whereas my clients used to be federal agencies and corporations, they are now individuals and their families and I enjoy it more this way.  I worry about the new reality in my profession of relying on generic nationally sold attorney software to generate estate planning documents without state specific and asset protection revision.  As with my LLCs, I draft and constantly seek to improve all my estate planning and elder law documents. I want my clients to have the benefits of both sophisticated software and of on the ground experience.

Nat B. Benson, Jr., Esq. / Benson Law Firm, LLC

Nat B. Benson, Jr. is the founding member of the Benson Law Firm since 2004 where he focuses his practice on estate planning, probate and elder law.  Nat was born in Canton, Ohio.  He earned a Bachelor of Business Administration degree with a major in Accounting from Kent State University.  Nat received his Juris Doctorate degree from the University of Akron while working full time as a financial analyst with the Timken Company.

Nat is a member of the the American Bar Association, South Carolina Bar Association, Charleston County Bar Association and the South Carolina Bar Association Elder Law Committee for over 35 years.  He has served as the president of the South Carolina Chapter of the National Academy of Elder Law Attorneys.

Nat and his wife have been heavily involved with lowcountry seniors for over 25 years.  They leased and managed several long term health care facilities in Mt. Pleasant.  He worked closely with senior facility residents, their families, governmental agencies and other health care facilities.

Since the inception of 2008 of the Accredited Agent program by the Veteran’s Administration, Nat has been an accredited attorney, allowing him to assist veterans and their spouses.

Nat is a member of the Huguenot Church of Charleston.
